A FEDERAL-STATE AI PREEMPTION CONFLICT

     As artificial intelligence (AI) regulation accelerates, an old federalism question is resurfacing: can the federal government preempt state AI laws absent congressional authorization?  The Trump Administration has signaled a deregulatory, hands-off approach to AI, while threatening to preempt state laws inconsistent with this federal policy.  States, meanwhile, continue to move forward with targeted AI legislation.
