As in Part I, the discussion will continue reviewing content regulation of social media today, largely focused on so-called “Section 230” of the Communications Act and it’s liability shield for online content providers. Beginning with an update of recent “Section 230” (47 USC § 230) case law, topics will all include the impact of the 2024 U.S. elections, the approach of the Trump administration (especially the Federal Communications Commission (FCC)) to Section 230, the prospects of Section 230 reform legislation, the regulatory landscape, and the societal impact of AI on content regulation. The discussion will include a special presentation on the origins of Section 230, enacted as part of the Communications Decency Act and other 1996 telecommunications reform legislation.
